Terms and conditions — Notenbrücke
Last updated: 1 August 2025
§ 1 Scope and contracting parties
These terms apply to all tuition contracts between Notenbrücke GmbH, Helenenstraße 88, 45143 Essen, Germany, and the person enrolling. The contracting party is always the parent or legal guardian, never the child. Differing terms apply only if we have agreed to them in writing.
§ 2 Formation of the contract
The presentation of our services on this website is not a binding offer. The contract is formed when the parent or guardian signs the enrolment form at a branch and we confirm the enrolment. Enquiries sent through the forms on this website are non-binding and commit you to nothing.
No contract is concluded and no payment is taken through this website, so no distance selling contract arises.
§ 3 Trial session
Before any contract is formed, every child is entitled to a free 90-minute trial session in a regular group. The trial session creates no obligation, and nothing is signed on the day.
§ 4 Services
We provide tutoring in groups of at most five students and in one-to-one sessions. A group session lasts 90 minutes, a one-to-one session 45 minutes. Teaching takes place exclusively on the premises of our branches; no online substitute lessons are offered.
The cap of five students per group and tutor applies without exception and is not averaged across the week.
§ 5 No guarantee of results
We owe the careful provision of tuition, not a particular academic outcome. No specific grade, progression to the next year or examination result is promised, and none forms part of the contract.
§ 6 Prices and payment
The fees published on the Prices page apply, and are identical at every branch: group of five twice a week €119 per month, one-to-one 45 minutes €39 per session, five-day holiday course €179 per course. A branch transfer is free. No registration fee, no materials fee and no examination fee is charged.
The monthly fee is collected by SEPA direct debit on the first working day of the month for the current month. The fee is already calculated across the teaching weeks of the school year; school holidays in North Rhine-Westphalia and public holidays are neither billed separately nor refunded separately.
Holiday courses are booked individually, paid before the course begins and are not part of the monthly agreement. Where benefits under the Bildungs- und Teilhabepaket apply, we bill the municipality directly once the voucher has been presented.
§ 7 Cancellation and rescheduling
Sessions cancelled by the parent or guardian at least 24 hours before the start are credited and rescheduled within four weeks. Sessions cancelled later, or simply not attended, count as delivered.
Sessions cancelled by us — for example because a tutor is ill or a branch is closed — are always credited and either rescheduled or refunded, regardless of when we tell you.
§ 8 Branch transfer
A place can be transferred to any other Notenbrücke branch at any time. The transfer is free, the fee is unchanged, and the teaching record is handed to the new branch. The place applies from the following week. If the group you want is full at the new branch, the existing place is kept until a seat becomes free.
§ 9 Term and termination
The contract runs for an indefinite period and has no minimum term. Either side may terminate with one month’s notice to the end of a calendar month. Notice must be given in text form; an email to the branch is sufficient.
The right to terminate for good cause without notice is unaffected.
§ 10 Supervision
We supervise children during the booked teaching time on our premises. We have no duty of supervision on the journey to or from a branch. Children under 12 are released only to the people named on the enrolment form unless otherwise agreed in writing.
§ 11 Liability
We are liable without limitation for intent and gross negligence, and for damage resulting from injury to life, body or health. In cases of simple negligence we are liable only for breach of a material contractual obligation, and then limited to the foreseeable damage typical of this type of contract. No liability is accepted for personal items brought onto the premises.
§ 12 Data protection
The processing of personal data is governed by our privacy policy. For data relating to children under 16 it is based on the consent of the parent or guardian under Art. 8 GDPR.
§ 13 Final provisions
The law of the Federal Republic of Germany applies. If the parent or guardian is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Essen. Should any provision be invalid, the remainder of the contract remains in force.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
§ 14 Language
This is a translation provided for convenience. In the event of any discrepancy the German version of these terms prevails.
